1. Acceptance of Terms

Welcome to DIWAI (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the DIWAI mobile application and associated services (collectively, the “Service”). By downloading, installing, or using DIWAI, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use the Service. We recommend that you read these Terms carefully before using the app.

2. Description of Service

DIWAI is an AI-powered Do It Yourself assistant available on iOS. The Service provides the following features:

• Project planning: take a photo of a repair, renovation, or improvement task, and DIWAI generates a detailed step-by-step project plan using artificial intelligence.
• AI Design Mode: photograph a room and receive AI-generated design concepts, mood boards, and visualisations to help you reimagine your space.
• Shopping lists: automatically generated materials and tools lists for your projects, with nearby store finder to locate hardware and DIY retailers.
• Step-by-step execution: guided walkthroughs for completing your projects, including safety guidance, estimated timings, and professional referrals where appropriate.
• Voice control: hands-free voice commands for navigating the app while working on projects.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration

To access certain features of the Service, you may create an account using one of the following methods:

• Email registration: create an account with your email address and a password.
• Apple Sign-In: sign in using your Apple ID for a seamless, privacy-focused authentication experience.
• Google Sign-In: sign in with your Google account for quick access.
• Guest mode: use limited features of the app without creating an account.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.

You must notify us immediately at support@diwai.app if you become aware of any unauthorised use of your account or any other breach of security.

4. Subscription Terms

DIWAI offers three subscription tiers to suit your needs:

Free

Basic access to DIWAI features at no cost. The Free tier includes limited project plans and basic functionality.

Pro

• Monthly: £4.99 per month
• Annual: £39.99 per year

Premium

• Monthly: £9.99 per month
• Annual: £79.99 per year

All paid subscription plans (Pro and Premium) include a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

Prices are in British Pounds Sterling (GBP) and may vary by region due to currency conversion and local tax requirements. We reserve the right to change subscription pricing at any time. Any price changes will take effect at the start of your next billing period following notice of the change.

Refunds are handled in accordance with Apple’s refund policies. To request a refund, please contact Apple Support or visit reportaproblem.apple.com.

5. User Content

When you use DIWAI, you may submit content including photographs, text descriptions, and voice input (“User Content”). You retain full ownership of your User Content.

By submitting User Content through the Service, you grant DIWAI a limited, non-exclusive, worldwide licence to process, transmit, and temporarily store your content solely for the purpose of providing the Service to you. This includes transmitting your photos and descriptions to our servers and to our AI processing partner (OpenAI) to generate project plans, design mockups, and other AI-powered features.

• Photos submitted for AI analysis are processed in real time and are not permanently stored on our servers after processing is complete.
• We do not use your photos or content for advertising, marketing, or training public AI models.
• You are solely responsible for the content you submit and must ensure you have the right to share it.

You must not submit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.

6. AI-Generated Content

DIWAI uses artificial intelligence to generate project plans, diagnoses, design mockups, shopping lists, cost estimates, and step-by-step instructions (“AI-Generated Content”). This content is provided for informational purposes only.

• AI-Generated Content is not a substitute for professional assessment, and you should always verify recommendations with qualified professionals before undertaking any work.
• This is especially important for work involving gas installations (which must be carried out by a Gas Safe registered engineer), electrical work (which should be carried out by a qualified electrician, such as one registered with NICEIC or NAPIT), and structural alterations (which require assessment by a structural engineer).
• Cost estimates are approximate and may not reflect actual prices in your area or at the time of purchase.
• Design mockups are conceptual visualisations and may not be achievable in practice due to structural, regulatory, or budgetary constraints.

DIWAI shall not be held liable for any loss, damage, injury, or expense arising from reliance on AI-Generated Content.

7. Safety Disclaimer

DIY projects can involve inherent risks, including but not limited to physical injury, property damage, and exposure to hazardous materials. While DIWAI strives to provide helpful safety guidance and professional referrals, you are solely responsible for your own safety when undertaking any project.

• DIWAI provides safety warnings and recommends professional referrals where appropriate, including links to registers such as Gas Safe Register and NICEIC.
• DIWAI does not inspect your property, assess on-site conditions, or verify the structural integrity of any surface, fixture, or installation.
• You must comply with all applicable local building regulations, planning permissions, and safety standards.
• You should always wear appropriate personal protective equipment (PPE) and follow manufacturer instructions for tools and materials.
• If you are unsure about any aspect of a project, you should consult a qualified professional before proceeding.

8. Intellectual Property

The DIWAI application, including but not limited to its design, source code, user interface, graphics, logos, branding, documentation, and all associated intellectual property rights, is owned by DIWAI and is protected by copyright, trademark, and other intellectual property laws.

• You are granted a limited, non-exclusive, non-transferable, revocable licence to use the app for personal, non-commercial purposes in accordance with these Terms.
• You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or disassemble any part of the Service or its underlying software.
• The DIWAI name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of DIWAI. You may not use such marks without our prior written permission.

All rights not expressly granted to you in these Terms are reserved by DIWAI.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• DIWAI does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• In no event shall DIWAI, its directors, employees, partners, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.
• Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or fifty pounds (£50), whichever is greater.

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

10. Termination

We may suspend or terminate your account and access to the Service at any time, without prior notice or liability, if you breach any provision of these Terms. Grounds for termination include, but are not limited to:

• Violation of these Terms of Service
• Engaging in fraudulent, abusive, or unlawful activity
• Submitting harmful, offensive, or illegal content
• Attempting to reverse-engineer, hack, or compromise the security of the Service
• Creating multiple accounts to circumvent usage limits or subscription restrictions

Upon termination, your right to use the Service will immediately cease. We may delete your account data in accordance with our Privacy Policy. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, and limitations of liability.

You may delete your account at any time through the app or by contacting us at support@diwai.app. Deleting your account does not automatically cancel any active subscription; you must cancel your subscription separately through your Apple ID settings.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. When we make changes, we will revise the “Last updated” date at the top of this page and, where appropriate, notify you via the app or email.

Material changes will be communicated at least 30 days before they take effect. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service.

We encourage you to review these Terms periodically to stay informed of any changes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. However, this does not affect any mandatory consumer protection rights you may have under the laws of your country of residence.
